By accessing or using FAASTIC’s services, you agree to comply with and be bound by these terms. Please review them carefully.
1. Applicability & Jurisdiction
a. These Terms of Service apply to all users and customers of FAASTIC's services globally. By using our services, you agree to adhere to these terms.
b. Regardless of your location, you expressly agree that the jurisdiction for any dispute with FAASTIC resides in the courts of Belgium and that the laws of Belgium, without regard to its principles of conflict of laws, will govern these terms and any dispute of any sort that might arise between you and FAASTIC.
c. Customers are required to comply with their local legislations and acknowledge that FAASTIC operates under Belgian and European legislations, including but not limited to, the General Data Protection Regulation (GDPR).
2. Use of FAASTIC Services
d. Prohibited Uses: Users are strictly prohibited from utilizing FAASTIC's services for the following purposes:
i. Establishing, supporting, or providing anonymous proxies or VPN services.
ii. Developing, operating, or maintaining blockchain services, miners and nodes that are not regulated or recognized by the European Union.
iii. Sending unsolicited commercial emails or any form of spam.
iv. Engaging in or facilitating malicious activities online, which include but are not limited to:
- Distributing malware, viruses, or harmful software.
- Engaging in phishing or other fraudulent practices.
- Run mining software that brings unusual wear and tear to the underlying hardware.
- Participating in denial-of-service attacks or network interference.
- Unauthorized access to, or theft of, data, systems, or networks.
- Distributing material that is illegal, defamatory, or violates the privacy rights of others.
- Engaging in activities that infringe upon intellectual property rights.
- Bots used to spam social networks, buy and scalp physical goods or tickets, bypass organisational security measures by third parties.
- Webscrapers not adhering to robots.txt and sending unreasonable requests to external services.
v. Any other activities that are illegal, harmful, or contrary to ethical usage practices.
vi. Regularly attracting or being the target of Distributed Denial of Service (DDoS) attacks, or any other form of network attacks, whether intentional or unintentional, which can affect the stability, integrity, or quality of FAASTIC services or the network for other users.
3. Liability & Data Management
a. Customer’s Code and Data Management:
i. FAASTIC is not responsible for issues, losses, or damages arising from malfunctioning code, data loss, or any other issues related to the content or data that customers bring, deploy, or use within FAASTIC’s platform.
ii. Customers are solely responsible for ensuring their code is functional, and data is secure, which includes but is not limited to, implementing sufficient data backup, recovery, and security mechanisms.
iii. Customers should thoroughly test and validate their code and data to ensure compatibility and functionality within the FAASTIC environment.
b. Service Outages and Limitation of Liability:
i. While FAASTIC aims to provide highly available, scalable, and redundant services, there may be occasions where services are unavailable due to planned maintenance, unexpected outages, or other reasons.
ii. FAASTIC’s liability in the event of service outages or any other issues related to our services, whether due to system failures, bugs, or other issues, will be limited to the amount paid by the customer for the service during the period of unavailability or malfunction.
iii. FAASTIC shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses, resulting from the use of our services or any related unavailability.
c. Precautions and Backups:
i. Customers are advised to take necessary precautions and maintain comprehensive backup solutions for their data and workloads hosted with FAASTIC.
ii. FAASTIC does not guarantee data persistence and is not responsible for any loss of customer data.
iii. It is incumbent upon the customer to ensure that their data and applications are safeguarded from loss through regular backups, redundancy solutions, or utilization of FAASTIC’s backup offerings when available.
- Termination Due to Violation of Terms
a. Right to Terminate: FAASTIC reserves the right to suspend or terminate services, without notice, for any customer found to be engaging in activities that violate these terms of service, disrupt our services, or cause harm to FAASTIC’s network, reputation, or other users of the services.
b. Involvement in Network Attacks: FAASTIC may, at its sole discretion, suspend or terminate the account(s) of any customer whose services are the target of a network attack (such as a DDoS attack) to protect the integrity of its network, even if the customer is unaware of or unrelated to the origin of the attack. FAASTIC will, to the extent feasible, notify the customer as soon as reasonably possible and work cooperatively to resolve the issue.
c. Legal Cooperation: FAASTIC may report any illegal activities to the relevant legal authorities and cooperate with those authorities by sharing necessary information to prevent, investigate, or take action against illegal activities, suspected fraud, or situations involving potential threats to the physical safety of any person.
d. Refund Policy Upon Termination: In the event of such termination, no refunds for unused services or features will be provided, and FAASTIC may seek damages from the user if any harm or loss has been caused to FAASTIC due to the violation of these terms.
By accepting these terms, users acknowledge that they are aware of FAASTIC’s right to terminate services under these circumstances and accept that FAASTIC will not be held liable for any impacts, consequences, or damages arising out of the termination of services in line with these provisions.
